Terms and Conditions

We will provide you with a written proposal covering the services to be supplied. That proposal and the following terms and conditions constitute the contract. If you have additional questions or require more information about our terms and conditions, please do not hesitate to contact us.

Payment can be made by check or credit card depending on the Service as noted in your written proposal.

Payment via credit card is done using PayPal.  You do not need to have a PayPal account in order to pay. You will be sent a Money Request via PayPal and payment of that request constitutes your receipt. Once payment is made, it is not refundable for any reason.

Cancellation of any services is to be made in writing via email in accordance with the specific service terms.  No monies will be refunded.

Notice of cancellation of an individual Service (that is not provided as part of a Package or Project) must be delivered at least 30 days prior to the next billing period.

Should cancellation not be made within that time frame, payment will be required for the next billing period regardless of whether services are supplied or not.

Packaged Services are provided at a discount rate for a minimum period of 12 months.  Cancellation of such services after the initial 12 months must provide three (3) months notice prior to the end of the contract period.

Project Services refer to website developments, redesigns and rebuilds.

Cancellation of Project Services may be made up until the time the project is handed over for user acceptance testing by providing one month’s notice.  Payment for any work in progress shall be required.

After handover for user acceptance testing, cancellation is not accepted for any reason. All monies owing must be paid.

No warranty is provided for any Services unless otherwise noted in your written proposal.

Copyright shall not be assigned:

• Whoever develops a graphic design retains copyright over that design.
• Whoever is author of software retains copyright over that code.
• Whoever is author of content  (text and/or images) retains copyright over that content.

All software is distributed under General Public License.

All stock photography is provided Royalty Free. Stock images may not be used for any purpose other than as supplied, namely on your website or specific social media post or email campaign. You may not take a stock image and re-use it for any other purpose.

Our contracts shall be governed by and construed in accordance with the laws of the State of New York.
